Rights and obligations of patients

Patients have the right to:

1) receiving a guaranteed amount of free medical care (GOBMP) in accordance with the list approved by the Government of the Republic of Kazakhstan, as well as additional services in excess of GOBMP at the expense of own funds, voluntary insurance system and other non-prohibited sources;

2) provision of medicines and medical devices within the framework of the GOBMP;

3) decent treatment in the process of diagnosis, treatment and care, respect for their cultural and personal values on the part of employees;

4) receiving medical care determined solely on the basis of medical criteria, without the influence of any discriminatory factors;

5) providing information on the names and professional status of those who will provide medical services, as well as on the internal regulations;

6) when performing invasive medical services, filling out the informed voluntary consent of the patient in writing. Written informed consent is signed by the patient after the doctor explains, in a form accessible to the patient, the planned invasive procedure, including information about the possible risks, benefits of the chosen procedure, alternative methods of treatment and diagnosis, as well as information about the possible consequences of refusing medical or diagnostic procedures.;

7) obtaining comprehensive information about the state of his health, information about the diagnosis, prognosis and treatment plan in a form accessible to the patient, as well as explaining the reasons for his discharge home or transfer to another medical organization;

8) to obtain comprehensive information about the prescribed drug;

9) participate in decision-making regarding treatment;

10) familiarization with the results of the examination. Obtaining a medical report and a copy of medical tests (at the request of the patient);

11) choosing or replacing a doctor;

12) receiving brief written information after discharge, including a treatment plan and recommendations explaining how to take care of your health;

13) support by legal representatives (in those branches where it is permissible);

14) pain relief to the extent that the current level of medical technology allows.;

15) obtaining an independent opinion on the state of one's health and holding a consultation;

16) to refuse to participate in the educational process, as well as from the presence of third parties (cadets) during medical and diagnostic procedures;

17) protection of rights by health authorities, organizations, as well as public associations within their competence;

18) providing an interpreter (if possible) if there is a language barrier in understanding the details of medical care (treatment);

19) submitting complaints, suggestions and comments on the services provided through the Patient Support Service or the complaints and Suggestions book;

20) receiving, at the request of the patient, a detailed invoice, with explanations of all expenses, regardless of whether the patient pays for services independently or through other sources. Obtaining the estimated planned treatment/diagnosis before the start of the procedures; cost

21) determining the choice of the person to whom information about his health status should be provided;

22) if the patient is under the age of majority or the patient is unable to exercise his rights for health reasons, these rights will be presented to his legal representative.;

23) other rights provided for by the Republic of Kazakhstan.


Responsibilities of the patient

The duties of the patient and his legal representative include:

1) respect the rules and regulations of the medical organization;

2) take measures to preserve and strengthen your health;

3) show respect and tact in dealing with medical professionals and patients;

4) inform the doctor of all information necessary for the diagnosis and treatment of the disease (complaints, previous illnesses, previous hospitalizations and treatments, as well as allergies, etc.), after giving consent to medical intervention, strictly follow all the prescriptions of the attending physician;

5) promptly inform medical professionals about changes in their health status during diagnosis and treatment, as well as in cases of diseases that pose a danger to others or are suspected of them.;

6) the patient is responsible for refusal or non-compliance with the treatment plan, after receiving information about the consequences of these decisions.;

7) observe internal regulations and take care of property, cooperate with medical personnel when receiving medical care;

8) do not commit acts that violate the rights of other patients, and respect the personal, confidential information of patients;

9) comply with safety regulations, including anti-smoking policies or any other public safety regulations;

10) make sure that financial obligations to the medical organization will be repaid on time;

11) in emergency cases, prioritize emergency cases;

12) perform other duties stipulated by the legislation of the Republic of Kazakhstan.

The right to refuse medical care:

1) If a patient or his legal representative refuses medical care, the possible consequences must be explained in an accessible form.

2) Refusal of medical care, indicating the possible consequences, is recorded in medical documents and signed by the patient or his legal representative, as well as by a medical professional.;

3) In case of refusal to sign by the patient or his legal representative

4) the representative of the refusal of medical care makes an appropriate entry about this in the medical documentation and is signed by a medical professional.

5) If the legal representatives of a minor or an incapacitated person refuse medical assistance necessary to save the lives of these persons, the medical organization has the right to apply to the guardianship and guardianship authority and (or) to the court to protect their interests.
